Welcome to Kennay Design. By engaging our interior design, architectural, or styling services, or by using our website, you agree to be bound by the following comprehensive Terms of Service. These terms ensure a clear, professional, and transparent working relationship throughout the duration of your project.

1. Scope of Design Services

Our services range from initial conceptualization and 3D space planning to the final styling of your property. While Kennay Design provides detailed architectural drawings, material specifications, and design oversight, we are not general contractors. Structural changes, electrical work, plumbing, and physical construction must be executed by licensed, independent contractors hired directly by the client or managed through a separate agreement.

2. Procurement & Custom Orders

A significant portion of luxury interior design involves the procurement of bespoke, custom-made furniture, fabrics, and specialized building materials. Please note the following regarding procurement:

  • Non-Refundable Items: Custom-upholstered furniture, cut fabrics, and bespoke cabinetry are entirely non-refundable and cannot be canceled once the order is placed with the manufacturer.
  • Freight & Delivery: Freight charges, warehousing fees, and white-glove delivery costs are the responsibility of the client and will be billed accordingly.
  • Damages in Transit: Kennay Design will act as your agent to inspect goods upon arrival at our receiver. We will manage claims for items damaged in transit on your behalf, but we are not financially liable for manufacturer defects or shipping damages.

3. Fees, Retainers & Payment Terms

Design services are billed either at an agreed-upon flat fee or at an hourly rate, as stipulated in your formal Design Agreement. A non-refundable retainer is required to commence any design work. For the procurement of goods, a 100% deposit of the item's cost is required before orders are placed. Final invoices for freight and delivery must be paid in full prior to the final installation day.

4. Project Delays & Force Majeure

The interior design industry is subject to global supply chain fluctuations. Kennay Design is not responsible for project delays caused by backordered fabrics, discontinued furniture, shipping strikes, extreme weather, or delays caused by third-party construction contractors. We will always communicate delays promptly and propose suitable design alternatives when necessary.

5. Intellectual Property

All design concepts, mood boards, 3D renderings, floor plans, and architectural drawings created by Kennay Design remain our exclusive intellectual property. Upon full payment of design fees, the client is granted a non-exclusive license to use these designs solely for the execution of the project at the specified property. The designs may not be resold, reused for other properties, or published without our explicit consent.

6. Limitation of Liability

While we strive for absolute perfection, Kennay Design shall not be held liable for the performance, quality, or omissions of independent contractors, architects, or artisans hired by the client. Our liability for any claim arising out of the design services shall not exceed the total design fees paid by the client to Kennay Design.

7. Termination of Agreement

Either party may terminate the design agreement with a 14-day written notice. Upon termination, the client is responsible for paying all hourly fees incurred up to the date of cancellation, as well as any outstanding invoices for custom goods that have already been placed into production by manufacturers.
